Terms of Service — askQ.live

These Terms of Service ("Terms") govern your access to and use of the askQ.live website, platform, and services (collectively, the "Service") operated as a sole proprietor with principal place of business at #26, 1st Main Road, Mathikere, Bangalore 560054, India ("askQ.live", "we", "us", or "our").

By accessing or using the Service, you ("you", "your", "User") agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About the Service

askQ.live is an online platform that enables users to create, host, and participate in interactive quizzes for the purposes of learning, entertainment, community engagement, and audience participation. The Service is provided over the internet on a software-as-a-service basis.

2. Nature of the Service — no real money gaming

askQ.live is expressly not an online real money game, a game of chance, a betting or wagering service, or an online money game as defined under the Promotion and Regulation of Online Gaming Act, 2025, or any predecessor or successor legislation.

You acknowledge and agree that:

Quizzes on askQ.live are for entertainment, learning, and engagement purposes only
No user makes any deposit, stake, or wager on the outcome of any quiz
No user is entitled to any monetary reward, cash prize, virtual token convertible to money, or any "winnings" (as that term is understood under applicable law) based on quiz performance
Voluntary tips and contributions accepted through the Service are entirely independent of, and are not payable on the basis of, quiz outcomes, scores, or rankings

You must not use the Service to run any activity that would cause it to be classified as an online money game, gambling, betting, wagering, lottery, or fantasy sport under any applicable law.

3. Eligibility

To use the Service you must be at least 18 years of age or the age of majority in your jurisdiction, whichever is higher. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at connect@askq.live if you become aware of any unauthorised use. We may suspend or terminate accounts that violate these Terms.

5. Host responsibilities

If you use the Service to host quizzes ("Host"), you agree that:

All quiz content you upload is either created by you or you have all necessary rights to use it
Your content does not infringe any third-party intellectual property, privacy, or other rights
Your content is not unlawful, defamatory, obscene, hateful, discriminatory, or otherwise prohibited under applicable law or these Terms
You will not use the Service to run any activity described in Section 2 as prohibited
You will comply with all applicable data protection laws in respect of your quiz participants

6. Participant responsibilities

If you join a quiz as a participant, you agree to use the Service respectfully, not to disrupt others' experience, and not to attempt to gain unauthorised access to the Service or other users' data.

7. Voluntary donations and contributions

The Service allows audience members to voluntarily send donations to Hosts on the Supporting Host plan and, separately, to askQ.live itself as a form of support. Users acknowledge:

Donations are entirely voluntary and are not required to access, view, or participate in any quiz
Donations are not linked to, and are not payable on the basis of, quiz outcomes, scores, or rankings
Donations intended for Hosts on the Supporting Host plan are collected by askQ.live on behalf of the Host as a facility. askQ.live retains 15% of each such donation as a platform service fee, and settles the remaining 85% (net of payment processing costs) to the Host on a monthly cycle, subject to a minimum settlement threshold and successful bank verification
Donations to askQ.live directly are retained in full by askQ.live
Donations are non-refundable except in cases of duplicate charge, technical failure, unauthorised transaction, or as required by applicable law — see our Refund Policy

7A. Host plan selection

Hosts may choose between the Free plan and the Supporting Host plan and may switch between them at any time from their account settings. Plan changes take effect immediately for future events. Donations already collected under a previous plan choice are settled according to the plan that was active when the donation was received.

7B. Host obligations under the Supporting Host plan

By enabling the Supporting Host plan, the Host agrees that:

Any bank account details provided for settlement belong to the Host and match the identity information on their askQ.live account
The Host is solely responsible for all applicable taxes, filings, and reporting obligations in respect of amounts settled to them by askQ.live
The Host will not solicit donations in a manner that suggests they are payments for any specific outcome, prize, or reward, and will not represent donations as anything other than voluntary contributions

8. Payments

Paid features of the Service are billed through Razorpay, our payment provider. By paying for a plan, you authorise us to charge the applicable amount, plus applicable taxes, to your chosen payment method for the relevant billing cycle. You are responsible for keeping your payment details current.

9. Subscriptions and cancellation

Paid subscriptions renew automatically at the end of each billing cycle unless cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing cycle. Refunds are governed by our Refund Policy.

10. Intellectual property

The Service, including its software, design, branding, and content created by us, is owned by us and is protected by intellectual property laws. You retain ownership of quiz content you create; you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and process your content solely to provide the Service.

11. Acceptable use

You must not:

Use the Service for any unlawful, fraudulent, or infringing purpose
Attempt to gain unauthorised access to the Service, other users' accounts, or our systems
Upload malicious code or interfere with the Service's operation
Scrape, crawl, or harvest data from the Service without our written consent
Impersonate any person or misrepresent your affiliation
Use the Service to run activities of the kind prohibited under Section 2

12. Third-party services

The Service integrates with third-party services including Razorpay for payments. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.

13. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

14. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the amount you have paid to us in the twelve months preceding the event giving rise to the claim, or ₹5,000, whichever is greater. We will not be liable for any indirect, incidental, consequential, or punitive damages.

15. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your quiz content, or your misuse of the Service.

16. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if required to comply with a legal or regulatory obligation.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified via email or an in-Service notice. Continued use of the Service after changes take effect constitutes acceptance.

18. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts at Bangalore.
