Terms of Service — askQ.live

Applicable to users in the United States.
1. Who we are & acceptance
askQ ("askQ", "we", "us"), a company registered in the Netherlands (KvK no. 74306634, VAT no. NL859847846B01) and operating from Steilte 4, 5629 TN Eindhoven, Netherlands, operates a web platform that lets hosts run live quizzes and lets audiences play along, answer, react, and support hosts with voluntary tips and donations. By using askQ.live you agree to these Terms.
2. Nature of the service — not gambling
askQ.live is an engagement and learning platform, not a real-money game, game of chance, or betting service. No user stakes or wagers anything on a quiz, and no cash prize or convertible reward is paid based on quiz outcome, score, or ranking. Tips and donations are voluntary and independent of quiz results.
3. Eligibility
You must be 18 or older to tip, donate, or transact. The service is not directed to children under 13 (COPPA); we do not knowingly collect their data.
4. Accounts & acceptable use
Transactions require a verified email. Keep your credentials secure. Don't defraud, spam, manipulate results, harass others, or post unlawful or infringing content. We may suspend or remove accounts and content that violate these Terms.
5. Donations, tips & fees
Tips and donations are charged immediately and are non-refundable once captured, except as required by law or in cases of duplicate charge, technical error, or unauthorized transaction. askQ.live retains a 15% platform share of donations to Supporting Hosts and settles the remaining 85% (net of processing costs) to the host on a monthly cycle. Payments and payouts are handled by Stripe; hosts are the payees.
6. Host content responsibilities
Hosts are solely responsible for ensuring they hold all rights to the quiz content they use, and that it is lawful and non-infringing. askQ.live grants no content rights and disclaims liability for host-supplied content.
7. Disclaimers & limitation of liability
The service is provided "as is" and "as available." To the maximum extent permitted by law, askQ.live is not liable for indirect or consequential damages, and our total liability is capped at the greater of the fees you paid us in the prior 12 months or US$100.
8. Binding arbitration & class waiver
Disputes are resolved by individual binding arbitration under the Federal Arbitration Act, and class actions are waived. You may opt out of arbitration by emailing connect@askq.live within 30 days of first accepting these Terms.
9. Copyright (DMCA)
We respond to DMCA notices and remove infringing content. Send notices to our designated agent at connect@askq.live; repeat infringers are terminated.
10. Governing law & termination
These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules. We may suspend or terminate access at any time; payment, arbitration, and liability terms survive.
